I came across a report recently, the ABA TECHREPORT 2017, that found merely 13% of practicing lawyers had used AI technology in the processing and review of eDiscovery materials. Furthermore, that percentage is essentially the same as the r previous year’s report results. Having seen first-hand the time and money this technology saves our customers, I wish these findings had surprised me.
I have to admit I’m not surprised at all. Our company, iControl ESI, has been offering the most advanced forms of AI in eDiscovery for years, and it hasn’t been easy to get lawyers to use it.
Much of this is because we – all of us in our industry – have made eDiscovery complicated, far more complicated than it needs to be. To understand AI in eDiscovery you need to learn a whole set of terms: TAR 1.0, 2.0, 3.0, SAL, CAL, SPL, LSI, LSA, SVM – and that’s just the acronyms, the words are even worse!
I even saw yesterday that one of our competitors had come up with a whole new acronym: CMML. I’ve been in this industry for decades, I have a Master’s Degree focused in Information Science, yet I must admit that even I couldn’t quite guess what those letters stand for. Don’t get me wrong, our competitor has an amazing AI system, groundbreaking in many ways, but I have to wonder that if I can’t quite figure out this new addition to the already bewildering alphabet of eDiscovery jargon, how anyone else is supposed to be able to do so.
